Terms and Conditions
Please read these Terms and Conditions carefully. By agreeing to receive SMS messages from Transfinder you agree to be bound by these Terms and Conditions and any other terms applicable to your use of Transfinder’s services.
Opt-in and Consent
When you opt-in to the Transfinder Notification SMS Messaging Service (“Messaging Service”), we will send you an SMS message to confirm your sign up. No further action is required to sign up once confirmed. Once signed up, you consent to receive SMS messages from Transfinder (“Transfinder”, “we”, “us”, “our”).
Opt-out and Re-enrollment
You can cancel the Messaging Service at any time by replying "STOP" to any message. Once we receive the "STOP" message, we will send you an SMS message confirming you have been unsubscribed. After this, you will no longer receive SMS messages from us. If later on you want to re-enroll, just sign up as if you were a new user to begin receiving SMS messages again.
Technical Support
For assistance or support, text "HELP" to #####. Once we receive the "HELP" message, we will respond with instructions on how to use the Messaging Service or unsubscribe.
Supported Mobile Service Providers
The Messaging Service is generally capable of delivering messages to individuals serviced by the following mobile service providers:
Major carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile.
Minor carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).
Carriers are not liable for delayed or undelivered messages. Transfinder, its agents, and/or employees are not liable for delayed or undelivered messages for any reason including due to loss of cellular service. It is your sole responsibility to ensure you have plan coverage and a device capable of receiving SMS messages.
Fees, Cellular Plan Details, and Message Frequency
As always, message and data rates may apply to any messages between us and you. For questions related to your cellular service plan or cost, please contact your wireless provider. Message frequency may vary.
Eligibility and Termination
Individuals must be 18 or older to participate in the Messaging Service. We reserve the right to terminate your receipt of messages under the Messaging Service if we believe you are in breach of any of these Terms and Conditions.
Release and Hold Harmless
You agree Transfinder, its agents, employees, contractors, subsidiaries, and/or affiliated companies and their respective officers, directors, employees, and representatives will have no liability whatsoever for, and shall be held harmless by you for any liability for injuries, losses or damages of any kind to persons, including death, or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of any message or participation in the Messaging Service.
Choice of Law
These Terms and Conditions shall be construed under the laws of the state and federal courts located in the State of New York, without regard for conflict of law principles, and any dispute arising therefrom shall be subject to the exclusive venue and jurisdiction of the courts of the State of New York.
General
You warrant you have the right, power, and authority to agree to these Terms and Conditions. The failure of either party to exercise any right provided herein will not be deemed a waiver of any right herein. If any provision of these Terms and Conditions is found unenforceable or invalid, that provision will be severed so the remaining terms will otherwise remain in full force. Any updates or changes to the Messaging Service shall be subject to these Terms and Conditions unless stated otherwise in writing. We reserve the right to change these Terms and Conditions. By continuing to utilize the Messaging Service you acknowledge you have reviewed and accepted these Terms and Conditions, including any modifications.
